Thank you for visiting www.FrommPro.com (the “Site”), which is owned and operated by Fromm International, LLC., (“Fromm”, “we”, “us”, and “our”), a leading marketer of beauty essentials in the professional beauty industry, with an emphasis on cutlery, salon apparel, combs, brushes, and other salon tools. Fromm products are instrumental to hair stylists in making their clients look beautiful. True to this goal, Fromm’s mission statement is Enhancing Beauty Experiences, which includes respecting the rights of individuals who visit our Site, order our Products, or otherwise interact with us, (collectively, the “Services”). We recognize the importance the privacy your personally identifying information has. This Privacy Policy sets out how we collect, use, share or otherwise disclose information that we collect from our customers, website visitors and users (collectively, the “Users” or individually, “you” or “your”), why we collect such information, how we use that information, and to whom and in what capacity we share or otherwise may disclose that information.

THE SCOPE OF THIS PRIVACY POLICY

This Privacy Policy applies to any activity or access you make with our Site or when you otherwise communicate with us about our products or our Services, including through email and text message/SMS/MMS.

INFORMATION WE COLLECT

Information You Provide

Our Site allows you to create an account. To do so, you provide us information about yourself that we collect and use so we can better assist you with identifying which of our Services best fit your needs. In this process, you may provide to us information such as your first and last name, your email, phone number, cosmetology license number and issuing state (if applicable) when setting up a professional account, and other information you choose to provide that may help us identify which of our Services would be appropriate for you. Creating an account will allow you to choose a username and password that you will be responsible for keeping safe (“Account Information”). In the event your username or password is compromised, you will need to access your account and change your log-in information or contact us directly and we can help you change it. If you forget your password, you can use the “Forgot Password” feature to reset it.

In the event you are eligible for the Fromm Pro Society loyalty program as a Licensed Salon Professional or Cosmetology Student, when setting up your account, you may also provide us status of your licensing or student credentials to register for the Fromm Pro Society.

Information We Collect Automatically

When you visit any website, it may store or retrieve information on your browser, mostly in the form of cookies. This information might be about you, your preferences or your device and is mostly used to make the site work as you expect it to. The information does not usually directly identify you, but it can give you a more personalized web experience.  When you visit the Site, we automatically collect certain information about the device you are using to access the Site, including information about your web browser, IP address, time zone, and information collected through cookies, web beacons and other tracking technologies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We collect Device Information using the following technologies:

We use performance cookies, which are cookies to allow us to count visits and traffic sources so we can measure and improve the performance of the Site, and functional cookies, which enable the Site to provide enhanced functionality and personalization.
  • “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
  • “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

We employ software technology that enables us to track certain aspects of a user’s visit to the Site. This technology helps us better manage content on the Site by informing us what content is effective, how consumers engage with the Site, and how consumers arrive at and/or depart from the Site. The software typically uses two methods to track user activity: (1) “tracking pixels” and (2) “clear gifs.” Tracking pixels are pieces of executable code that are embedded in a web page that track usage activity including which pages are viewed, when they are viewed, electronic communications and date, such as full-string, detailed URL for each page of our Site and user views, and how long the pages are viewed. Clear gifs are tiny graphics with unique identifiers which are embedded in web pages and email messages that track whether or not a user has viewed a particular web page or email message. User activity information may be associated with additional information about a user’s session and Personal Information, if provided by the user.

If you arrive at the Site by “clicking through” from another website, then certain information about you that you provided to that other website, such as the terms you were searching on that led you to the Site, may be transmitted to us and we may use it. You should review the privacy policy of any website from which you reached the Site to determine what information was collected by that website and for what purpose(s) you agreed that website could use that information. We may retain information about you provided to us by other websites and will only use it in accordance with this Privacy Notice.

The Site may include social media features, such as the Facebook, TikTok, YouTube, LinkedIn, and X (formerly Twitter) widgets. These features may collect information about your IP address and the pages you visit on our website as well as other Personal Information. A cookie may be set to ensure that a feature properly functions. Your interactions with features are governed by the privacy policies of the companies that provide them. Before you choose to interact with these features, you should review the relevant social media company’s privacy policy.

When you make a purchase or attempt to make a purchase through the Site, we collect your name, your order number (to allow us to find your order), phone number, and shipping address. We refer to this information as “Order Information”. When we talk about “Personal Information” in this Privacy Policy, we are talking both about your personally identifying information, Account Information, Device Information and Order Information. Notably, we do not collect your financial information, such as your debit/credit card information when you make a purchase from the Site. Rather, a third-party is responsible for processing those transactions so we only see details about your order that allow us to process it, but not payment information.

We use OneTrust’s Cookie Consent Tool that allows you to customize your cookie preference on the Site. This tool provides you with the flexibility to opt-in or opt-out of different categories of cookies according to your preferences. You will see this tool usually as a pop-up where you can control your settings, and also as a link in the footer of the Site.

Information Obtained from our Third-Party Partners

When you engage with us with respect to some of our Services, we work with third party representatives, called service providers, who prospect for us and may collect information about you to better help us provide our Services to you. Our third-party service providers who operate those functions on our behalf may collect information that you provide and then provide it to us.

If you are from the European Union (“EU”), European Economic Area (“EEA”) or United Kingdom (“UK”) our legal basis for collecting and using the Personal Information described in this Privacy Policy is based on Art. 6(1)(B) of the General Data Privacy Regulation (“GDPR”) and UK General Data Privacy Regulation (“UK GDPR”) (performance of a contract);  Art. 6 (1)(f) GDPR and UK GDPR (balancing of interests, based on our legitimate interest in constantly and profitably improving the content, functionality and attractiveness of our Site by analyzing your usage); Art. 6 (1)(c) of the GDPR and UK GDPR (necessary for compliance with a legal obligation to which we are subject); and/or Art. 6(1)(a) of the GDPR and UK GDPR (consent), depending on the Personal Information we collect and the specific context in which we collect it.

HOW WE USE YOUR PERSONALLY IDENTIFYING INFORMATION 

We generally use information that we collect for the purposes of fulfilling our contractual obligations to you, in furtherance of our legitimate interests in operating the Services and our business and/or where you have consented to such usage. More specifically, however, we use your personally identifying information in the following ways:

  • To Communicate with you. This includes about your account, order processing, account deletion, etc.
  • To fulfill / process your order. This includes to ensure your order is correct, to ensure it is being delivered to the correct person/address, to address any issues with payment, returns, exchanges, and to facilitate, operate, and improve our business and lawful business activities.
  • To register you for Fromm Pro Society loyalty program and to Communicate with you about that program. This includes to ensure you meet the eligibility requirements for Fromm Pro Society, to run Fromm Pro Society, and to communicate with you about your rewards, reward bank, reward use, etc.
  • To provide, update, maintain and protect the Services and our business. This includes to support delivery of the Services, prevent or address service errors, security or technical issues, analyze and monitor usage, trends and other activities or at your request. We may use your email address or phone number to send you notices (including any notices required by law, in lieu of communication by postal mail). If you correspond with us by email, we may retain the content of your email messages, your email address and our responses.
  • To personalize your experience and improve customer service. This includes to help us better understand your buying/shopping preferences so that we may be able to advertise other products that you might be of interest and to determine your level engagement. Your information also helps us to more effectively respond to your customer service requests and support needs.
  • To detect and screen our orders for potential risk or fraud and other technical issues.
  • As required by applicable law, legal process or regulation. We may, in certain instances, be compelled by law to process your personally identifying information to comply with a binding order. We will only do so to the extent reasonably required by that order.
  • To enforce our Privacy Policy, our Terms of Use, our other policies, and to monitor for violations of our policies or other applicable laws.
  • To communicate with you by responding to your transactions, requests, comments and questions. If you contact us, or to communicate with you regarding an order, we may use your contact information to communicate with you, including sending you responsive or informational emails.

We may also use your personally identifying information to send you marketing messages and may provide such information to third parties to send you information about our products and services. This includes determining your level of engagement with SMS/MMS, email or promotional marketing materials that are sent to you, including whether you opened an email or promotional marketing materials and/or otherwise engaged with it.
  • To improve our Site and/or Services. We continually strive to improve our Site offerings and/or our Services based on the information and feedback we received from our users and visitors. This includes by allowing you to leave reviews and collect and utilize the information from your reviews.
  • For any other purposes communicated to you at the time we collect information and, if required, by law for which consent has been obtained
  • In the context of a bankruptcy, company dissolution, merger or acquisition; and
  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • We also use information as otherwise described in this Privacy Policy, permitted by law, or as we may notify you.

We use anonymized, de-identified and aggregated data generated to provide insights to our customers, including usage information about the use of our Site and the products our customers are orders, looking at buying, and where they are buying from. We also use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

The legal basis for the associated processing of your personally identifying information is Art. 6 (1)(f) GDPR (balancing of interests, based on our legitimate interest in constantly and profitably improving the content, functionality and attractiveness of the app by analyzing your usage) as well as Art. 6 (1)(b) GDPR (performance of a contract) and Art. 6 (1) a) GDPR (your consent).

HOW WE SHARE OR OTHERWISE DISCLOSE YOUR PERSONALLY IDENTIFYING INFORMATION 

We may share, transfer and/or disclose your personally identifying information to or with service providers or third parties in order to provide the Services or products requested or purchased by you, and under the following circumstances:

  • We share certain personally identifying information with our employees, including our internal sales group, to provide you our Services; third-party partner representatives who may follow-up with you on our behalf to see how we may be able to best provide our Services and; other third business partners necessary in order to fulfill an order placed through the Services. These third-party service providers are contractually or otherwise legally prohibited from using your personally identifying information for promotional purposes or from selling your personally identifying information. These service providers may have access to information about you if it is needed to perform their functions for us, but they are not authorized by us to use or disclose such information except as necessary to perform services on our behalf or to comply with legal requirements, and they are required to maintain the information in confidence.
  • We may share personally identifying information and other information we collect with our service providers and other third parties in connection with our marketing and business development efforts.
  • We share certain information that is traditionally not considered personally identifying information (such as device, analytics, and usage data) for purposes of better understanding the usage of the Services by Users and improving on that experience.
  • We reserve the right to disclose personally identifying information as permitted or required by law; when we believe disclosure is necessary to protect our rights or to comply with a legal process; and/or in the event it is necessary to prevent, investigate or take action regarding unlawful, illegal or suspicious activities that violate the Terms and Conditions or this Privacy Policy.
  • We may share your personally identifying information in response to legal process, for example, in response to a court order or a subpoena, a law enforcement or government agency’s request or similar request.
  • We may share your personally identifying information with third parties in order to investigate, prevent, or take action (in our sole discretion) regarding potentially illegal activities, suspected fraud, situations involving potential threats to any person, us, or the Services, or violations of our policies or the law.
  • We may transfer personally identifying information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personally identifying information held by us about our Users is among the assets transferred.

We work with third-party service providers that supply website and application development, hosting, maintenance, storage, virtual infrastructure, payment processing, research, advertising, marketing, analysis, and other services for us, which may require them to access or use of your Personal Information. However, in the event one of our third-party service providers needs to access your Personal Information to perform services on our behalf, they must also agree to comply with all portions of this Privacy Policy. We engage and share certain Personal Information with third party service providers / partners as follows:

  • We also use Google Analytics 4 to help us understand how our customers use the Site. Specifically, Google Analytics 4 does not log or store individual IP addresses. Analytics does provide coarse geo-location data by deriving the following metadata from IP addresses: City (and the derived latitude, and longitude of the city), Continent, Country, Region, Subcontinent (and ID-based counterparts). For EU-based traffic, IP-address data is used solely for geo-location data derivation before being immediately discarded. It is not logged, accessible, or used for any additional use cases.   • We also use Meta Remarketing to analyze data.   • We use Google Ads Pixel and Microsoft Advertising Pixel, which allows us to track remarketing and conversion.

  • We share delivery information with our third party warehouse provider to ensure that orders are processed properly.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights. 

All information voluntarily shared by you through forums, comments, or blog posts is publicly available and your username may be visible by other Users. We are not responsible for any information you submit that can be read by other Users and can be used to send you unsolicited information by other Users.

We do not sell or share (in the context of cross-behavioral advertising which means the targeting of advertising to a consumer based on the consumer’s personal information obtained from the consumer’s activity across businesses including distinctly-branded websites, applications, or services) your personal information, including sensitive personal information, and have not in the immediate twelve months. If we do, you will be notified of it prior to or at the point of such collection for those purposes, and provided a link to opt-out of the selling/sharing of your personal information.

THIRD PARTY FEATURES, LINKS AND PRIVACY POLICIES

The Site may include service features and augmentations operated by other companies that are not our service partners, but which provide features that we believe users may appreciate, such as social media widgets, links to third-party websites, advertisements and other third-party content (“Third Party Features”). Users who choose to access any Third Party Features, must understand the following:  (1) we do not operate, control or monitor Third Party Features, and these features are subject exclusively to the privacy policies of the companies that operate them; (2) this Privacy Policy does not apply to information collected by any third party, including through any Third Party Features; and (3) we are not responsible for the privacy practices, the placement of cookies on your computer by any third party, or any content you may encounter via Third Party Features. Users who decide to access any Third Party Features, should read the privacy policy of each linked website to understand the privacy practices that apply to those features. 

The Site uses cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart and this information is used to determine when to send cart reminder messages via email or SMS/MMS.

DO NOT TRACK (INCLUDING CALIFORNIA AND DELAWARE DO NOT TRACK DISCLOSURE)

Do Not Track is a privacy preference that users can set in their web browsers. When a user turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the user. At this time, we do not respond to web browser “do not track” settings or signals. We deploy cookies and other technologies on our Services to collect information about you and your browsing activity, even if you have turned on the Do Not Track signal.

MOBILE TERMS AND CONDITIONS

Our mobile message Service (the “Mobile Services”) is operated by us or by a third party on our behalf. If you provide us with your mobile phone number, it must be your own and may not be anyone else’s as, by doing so, you are proving affirmative consent (i.e., opting in) to receive recurring advertising and other text messages from and on behalf of Fromm  via an automatic telephone dialing system to the mobile phone number you provide. Your consent to receiving such messages is not a condition of purchasing any goods or services.

We may modify or cancel the Mobile Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Mobile Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to our Mobile Service, you agree to receive recurring SMS/MMS text messages from and on behalf of Fromm through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Mobile Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with us. Your participation in this program is completely voluntary.

We do not charge for the Mobile Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/MMS text messages, including charges from your wireless provider.

You may opt-out of the Mobile Service at any time. Text the single keyword command STOP or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Fromm mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Mobile Service at any time. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Mobile Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Mobile Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Mobile Service.

CONSENT TO RECEIVE ELECTRONIC NOTIFICATIONS

Electronic communication is the most effective and timely way to provide the users of the Site and purchasers of our products with any optional or required notifications and disclosures. In some circumstances, however, state and/or federal laws may require us to send you disclosures or communications in paper format unless you have affirmatively consented to receiving electronic notifications only in advance of the notification. Through this Privacy Policy pursuant to 15 U.S.C. § 7001, you hereby affirmatively consent to receive electronic notifications and disclosures from us only (without requiring a paper copy) and you represent that, to date, you have not withdrawn such consent. You have the right to change your mind and withdraw your consent at any time. If you would like to withdraw your consent to receive electronic notifications and/or would like to request a paper copy of any electronic notifications you receive, please contact us. To receive electronic records, you will need access to a smartphone, tablet, laptop or computer with Internet access and either email software (such as Microsoft Outlook) or access to a web-based electronic mail software platform, such as Gmail, Yahoo or other electronic mail provider.

DATA RETENTION

We will retain your personally identifying information for as long as is reasonable or appropriate for the purposes set out in this Privacy Policy. We will also retain and use your Personally identifying information to the extent necessary or reasonable to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

TRANSFER OF DATA

If you are located outside the United States, please note that we transfer data, including personally identifying information, to the United States and process it there.

By using the Services, you understand and acknowledge that your personally identifying information will be transferred to and processed in the United States, which may have different data protection rules than in your country.

YOUR DATA SUBJECT RIGHTS

UK/EU/EEA Data Subject Data Protection Rights Under General Data Protection Regulation (GDPR)

If you are a resident of the United Kingdom, European Union, or European Economic Area (EEA), you may have certain data protection rights. We aim to take reasonable steps to allow you to correct, amend, delete, or limit the use of your personally identifying information, though understanding that some of these rights to not extend to business to business, also known as B2B data.

If you wish to be informed about what personally identifying information we hold about you, have a copy of it, correct or otherwise rectify it, and/or if you want it to be removed from our systems, please contact us using the contact information set out below.

In certain circumstances, you have the following data protection rights:

  • Request access to your personally identifying information (commonly known as a "data subject access request"). This enables you to receive a copy of the personally identifying information we hold about you where we are the data controller and to check that we are lawfully processing it.
  • Request correction of the personally identifying information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected, though we may need to verify the accuracy of the new information you provide to us.
  • Request erasure of your personally identifying information. This enables you to ask us to delete or remove personally identifying information where there is no good reason for us to continue to process it. You also have the right to ask us to delete or remove your personally identifying information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personally identifying information to comply with local law. Note, however, that we may not always be able to comply with your request for erasure for specific legal reasons, which will be explained to you, if applicable, at the time of your request.
  • Object to processing of your personally identifying information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground, as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personally identifying information for direct marketing purposes.
